📄 TERMS OF SERVICE – Mobile Garage HK

This website is operated by Mobile Garage HK. Throughout the site, the terms “we”, “us” and “our” refer to Mobile Garage HK. By accessing our website or purchasing from us, you agree to be bound by the following Terms of Service, including all policies (Shipping Policy, Refund & Return Policy) referenced herein.

1. Eligibility & Use

By using this site, you confirm that you are of legal age in your jurisdiction or have obtained consent from a legal guardian. You agree not to use our services for any unlawful purpose or violate any applicable laws. Any breach of these terms may result in the immediate termination of your account and services.

2. Product Availability & Condition

  • Stock Status: Most items are in-stock and ready to ship. Pre-order items will display estimated release dates (ETA) in the product description. Please note that ETAs are subject to manufacturer delays and do not constitute grounds for fee-free cancellation.

  • Product Condition: All products are brand new and factory-sealed unless otherwise stated. All items are sold "As-Is" based on product photos. We recommend contacting us for any clarification before purchasing.

3. Combined Shipping & Reserved Items

  • We offer combined shipping to help reduce costs. Items held for combined shipping will be stored for up to 3 months from the release date. If no response is received after a reminder, items may be relisted without refund.

  • Abandonment: If a parcel is destroyed or disposed of by the courier due to the buyer's failure to claim, wrong address, or refusal to pay duties, no refund will be issued as per our Shipping Policy.

4. Order Processing & Cancellation

  • Orders are processed within three (3) business days after payment confirmation.

  • Cancellations are subject to administrative fees:

    • Within 72 Hours: 7% processing fee.

    • After 72 Hours / Returned to Sender (RTS): 20% administrative fee.

  • Pre-order Specific Rule: Pre-orders are strictly subject to the 7% or 20% fee structure. These fees apply to Pre-orders regardless of the refund method (including Shop Credit).

  • For In-stock items, fees are only waived if the refund is issued via Shop Credit.

5. Pricing & Modifications

Prices are subject to change without notice. We reserve the right to modify or discontinue any product at any time. We are not liable for any changes, price fluctuations, or suspensions.

6. Accuracy of Information

We strive for accuracy, but we do not guarantee that all product descriptions or pricing are error-free. We reserve the right to correct any errors and cancel orders if necessary. If an order is cancelled due to our error, a full refund will be provided.

7. Shipping Damage & Evidence Requirements

  • Mandatory Evidence: For any claims regarding damage or incorrect items, you MUST provide a continuous, unedited unboxing video starting from the unopened shipping box. Claims without this video will be summarily rejected.

  • Visible Damage: If a parcel arrives visibly damaged, please refuse delivery. Once signed, you assume responsibility unless a valid unboxing video proves interior damage.

  • Exclusions: Factory defects and minor transit-related box wear (scratches/dents) are not covered under our claims policy.

8. Third-Party Services & Links

We are not responsible for the content, accuracy, or policies of third-party websites or payment gateways. Use of such services is at your own risk.

9. Intellectual Property & Anti-Fraud

You agree not to reproduce or exploit any part of our service. Mobile Garage HK maintains a zero-tolerance policy towards fraudulent chargebacks. We will contest all fraudulent claims with pre-shipping documentation and tracking records.

10. Privacy

Your submission of personal information is governed by our Privacy Policy.

11. Prohibited Uses

You may not use our site for any unlawful, abusive, or harmful purposes, including spamming, hacking, or violating intellectual property rights.

12. Limitation of Liability

Mobile Garage HK shall not be liable for any direct, indirect, or incidental damages arising from your use of our services, including but not limited to lost profits or transit delays.

13. Governing Law

These Terms of Service are governed by the laws of Hong Kong. Any disputes shall be resolved under Hong Kong jurisdiction.

14. Changes to Terms & Policy Conflict

We reserve the right to update these Terms at any time.

  • Conflict Clause: In the event of any conflict between these Terms of Service and our specific Shipping Policy or Refund & Return Policy, the specific terms of those policies shall prevail.
